Terms of Service

These Terms of Service (“Terms”) govern your use of rootedcoliving.com, the Rooted Platform, operator tenant sites, guest portal, marketplace, and all related services (collectively, the “Service”) operated by Rooted Co-Living (“Rooted,” “we,” “us,” or “our”). By using the Service, you agree to these Terms.

1. Service Description

Rooted provides:

  • For operators: A SaaS platform to manage recovery housing operations including marketing websites, application forms, bed management, guest portals, referral inboxes, and marketplace listings
  • For guests: A portal to manage residency, check-ins, wellness tracking, documents, and communication with house staff
  • For case managers: A marketplace to search recovery housing, view real-time bed availability, and submit referrals

2. Accounts

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 18 years of age to create an account
  • One person or organization may not maintain multiple accounts without authorization
  • You must notify us immediately of any unauthorized use of your account

3. Operator Terms

If you use the Service as a recovery housing operator:

Subscription Plans

  • One House ($99/month), Growing ($249/month), and Network ($499/month) plans are available
  • Plans are billed monthly via Stripe. You authorize recurring charges to your payment method
  • You may upgrade or downgrade your plan at any time. Changes take effect at the next billing cycle
  • A one-time setup fee of $500 applies to all plans and is non-refundable once work has begun

Cancellation and Refunds

  • You may cancel your subscription at any time from your billing settings
  • Cancellation takes effect at the end of the current billing period. No partial-month refunds are issued
  • Upon cancellation, your tenant site and marketplace listings will be deactivated. Your data remains accessible for 90 days, after which it will be permanently deleted unless you request an export

Operator Responsibilities

  • You are solely responsible for the operation of your recovery housing, compliance with local laws, licensing requirements, and housing regulations
  • Content you publish on your tenant site (descriptions, testimonials, photos) must be accurate and not misleading
  • You must respond to referrals within 24 hours as indicated by the platform's SLA tracking
  • You must maintain accurate bed availability information
  • You are responsible for the privacy and security of guest data you collect through the platform

Data Ownership

  • You retain ownership of all data you input into the platform (guest records, property details, financial information, site content)
  • You grant Rooted a limited license to use this data solely to operate the Service
  • Upon request, we will provide an export of your data in a standard format within 30 days
  • Rooted retains the right to use anonymized, aggregated data for analytics and platform improvement

Approval

New operator accounts require approval by Rooted before tenant sites and marketplace listings become publicly visible. We reserve the right to reject or revoke approval at our discretion.

4. Guest Terms

  • Guest portal access is provided by your housing operator through the Rooted Platform
  • Information you submit through the portal (check-ins, wellness data, maintenance requests) is shared with your housing operator's staff
  • Electronic signatures on agreements (license agreements, house rules) are legally binding
  • You may request deletion of your account and data by contacting your operator or Rooted directly

5. Case Manager / Referral Terms

  • The marketplace and referral tools are free for case managers
  • By submitting a referral, you confirm you have permission to share the client's information with the receiving operator
  • Bed availability information is provided in real-time but not guaranteed. Operators may accept, waitlist, or decline referrals
  • Rooted is not responsible for operator response times, acceptance decisions, or quality of housing services

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Submit false or misleading information
  • Attempt to access another user's account or data
  • Interfere with or disrupt the Service
  • Scrape, crawl, or automated-access the platform without authorization
  • Use the Service to discriminate against protected classes in housing decisions
  • Upload malicious content, viruses, or harmful code
  • Impersonate another person or organization

7. Intellectual Property

  • The Rooted Platform, including its design, code, and functionality, is the intellectual property of Rooted Co-Living
  • Operator tenant sites are generated using Rooted's templates. Operators own their content; Rooted owns the underlying template and technology
  • You may not copy, modify, or reverse-engineer the platform

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee uninterrupted access, error-free operation, or that the Service will meet your specific requirements.

Rooted is a technology platform, not a housing provider (except for properties directly operated by Rooted Co-Living). We do not guarantee the quality, safety, or legality of housing provided by third-party operators on the platform.

9. Limitation of Liability

To the maximum extent permitted by law, Rooted's total liability to you for any claims arising from or relating to the Service is limited to the amount you paid to Rooted in the 12 months preceding the claim.

Rooted is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption.

10. Indemnification

You agree to indemnify and hold harmless Rooted, its officers, employees, and agents from any claims, damages, or expenses arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any law or regulation, or (d) content you submit to the platform.

11. Termination

  • We may suspend or terminate your account for violation of these Terms with or without notice
  • You may terminate your account at any time by contacting us or through your account settings
  • Upon termination, your right to use the Service ceases immediately
  • Sections 8, 9, 10, and 13 survive termination

12. Health Information Disclaimer

Rooted Co-Living is not a healthcare provider and does not provide medical advice, diagnosis, or treatment. Recovery-related features (wellness check-ins, sobriety tracking, meeting logs) are administrative tools, not clinical services. If you are experiencing a medical or mental health emergency, call 911 or the 988 Suicide and Crisis Lifeline.

13. Dispute Resolution

  • These Terms are governed by the laws of the State of California
  • Before filing a formal dispute, you agree to contact us at info@rootedcoliving.com and attempt to resolve the issue informally for at least 30 days
  • Any disputes not resolved informally shall be settled by binding arbitration in Riverside County, California, under the rules of the American Arbitration Association
  • You agree to resolve disputes on an individual basis and waive any right to participate in class action lawsuits

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
